Special Claims: TDIU, SMC, and More
Beyond standard disability ratings, there are special benefits that can significantly increase your compensation. This guide covers TDIU, Special Monthly Compensation, and other important special claims.
Total Disability Individual Unemployability (TDIU)
TDIU allows Veterans who cannot maintain gainful employment due to service-connected disabilities to receive compensation at the 100% rate—even if their combined rating is less than 100%.
TDIU Eligibility Requirements
You must meet ONE of these rating thresholds:
- Single condition: One service-connected disability rated at 60% or more, OR
- Multiple conditions: Two or more disabilities, with at least one rated 40%+, and a combined rating of 70%+
What Counts as "One Disability"
These are considered a SINGLE disability:
- Disabilities of one or both upper extremities
- Disabilities of one or both lower extremities
- Disabilities affecting a single body system
- Disabilities from a single incident (IED, vehicle crash, etc.)
- Disabilities incurred as a POW
AND you must demonstrate that your service-connected disabilities prevent you from maintaining substantially gainful employment.
What About Working?
You can still work while receiving TDIU if:
- Your earned income is below the poverty threshold (marginal employment)
- You work in a sheltered/protected environment
How to Apply for TDIU
- File a claim for disability compensation (21-526EZ) including "Unemployability"
- Complete VA Form 21-8940 (TDIU Application)
- Have former employers complete VA Form 21-4192
TDIU Tips
- You can apply without meeting the rating thresholds—VA may still grant if warranted
- List last 5 years of work history, not last 5 calendar years
- If former employer is out of business, note it on your application
- VA will review Social Security records and VR&E history
Special Monthly Compensation (SMC)
SMC provides additional compensation for Veterans with specific severe disabilities or combinations of disabilities. Rates range from slightly above 100% to over $11,000/month.
SMC K: Loss of Use
Awarded for specific anatomical losses or loss of use. Paid in addition to regular compensation.
- Loss or loss of use of a hand or foot
- Loss or loss of use of reproductive organ (includes erectile dysfunction)
- Complete deafness in both ears
- Loss of sight in one eye (light only)
- Complete organic aphonia (loss of voice)
- Loss of 25%+ breast tissue from mastectomy/radiation (females)
You can receive up to 3 SMC-K awards simultaneously.
SMC S: Housebound
Two ways to qualify:
Statutory Housebound (Automatic)
Have a single 100% rating PLUS additional disabilities combining to at least 60%.
- TDIU based on a single condition counts as the "single 100%"
- Temporary 100% ratings (hospitalization/convalescence) also count
Housebound In-Fact
You're substantially confined to your dwelling due to service-connected disabilities. Leaving for medical appointments or occasional religious services doesn't disqualify you.
SMC L: Aid and Attendance
Awarded if service-connected disabilities cause:
- Loss or loss of use of both feet
- Loss or loss of use of one hand and one foot
- Blindness in both eyes
- Being permanently bedridden
- Need for daily help with basic needs (feeding, bathing, dressing, toileting)
SMC L½ through SMC O
Higher levels for more severe combinations of anatomical losses and disabilities. These are complex—consult a VSO or attorney if you believe you qualify.
SMC R: Special Aid and Attendance
For Veterans eligible for SMC O or SMC N½+K who require assistance with most daily activities. SMC R2 is for those who would require hospitalization or nursing home care without a skilled caregiver.
SMC T: TBI Aid and Attendance
Specifically for Veterans with TBI who need regular aid and attendance due to TBI residuals. Paid at the SMC R2 rate.
Temporary 100% Ratings
Hospitalization (38 CFR 4.29)
If hospitalized at a VA or approved hospital for 22+ continuous days for a service-connected condition, you receive 100% pay during hospitalization.
Convalescence (38 CFR 4.30)
Following surgery on a service-connected condition, you may qualify for temporary 100% if:
- Recovery requires at least 1 month of convalescence
- You have severe post-surgical residuals (incompletely healed wounds, immobilization, house confinement)
- You require continued use of wheelchair/crutches
How to File
File a new claim for "temporary 100% due to hospitalization" or "convalescence" with medical evidence showing:
- The service-connected condition treated
- Dates of hospitalization or surgery
- Length of required convalescence
Other Special Benefits
Automobile Allowance
One-time grant toward purchasing a vehicle if you have service-connected:
- Loss or permanent loss of use of one or both hands or feet
- Permanent impairment of vision in both eyes
- Severe burn injury
- Amyotrophic lateral sclerosis (ALS)
Adaptive Equipment
VA may pay for equipment to make your vehicle accessible (hand controls, lifts, etc.).
Clothing Allowance
Annual allowance if your service-connected disability requires:
- A prosthetic or orthopedic device that damages clothing
- Medication for a skin condition that damages clothing
Specially Adapted Housing (SAH)
Grants for Veterans with certain permanent and total disabilities to modify or purchase accessible housing.
Special Home Adaptation (SHA)
Smaller grants for Veterans with specific service-connected disabilities to adapt their homes.
Permanent and Total (P&T) Status
If your disabilities are rated 100% and determined to be permanent (unlikely to improve), you receive "P&T" status. Benefits include:
- No future re-examinations
- Chapter 35 education benefits for dependents
- CHAMPVA healthcare for dependents
- Property tax exemptions (varies by state)
- Expedited Social Security disability processing
Secondary Service Connection
When a service-connected disability causes or worsens another condition, you can claim the new condition as secondary.
Common Secondary Claims:
- Depression/anxiety secondary to chronic pain
- Knee problems secondary to ankle/hip conditions (altered gait)
- GERD secondary to medications for service-connected conditions
- Sleep apnea secondary to PTSD or obesity from medication side effects
- Radiculopathy secondary to back conditions
